 OUR RENTAL AGREEMENT IS REVISED PERIODICALLY - AND MAY BE DIFFERENT 

It is agreed this ______ day of __________ , 2000, that _________________________ (TENANT) , having an address at _____________________________, will rent 409 Adirondack Court, Marco Island, Florida from PAUL J DEMOS, the OWNER. This occupancy will be in the form of a Vacation Rental only and not constitute a permanent or primary residence. Occupancy shall begin on ________, 2000 (After 3:00 PM) and terminate on ________, 2000 (Before 11:00 AM). The following are the specifics of this agreement:

SECURITY: Security is required in the amount of $500.00. It is payable prior to occupancy and is due in Personal Check, Bank Check or Bank Wire. Security will be held in a non-interest bearing account. Applicable security will be returned to the TENANT within thirty (30) days after termination of this Agreement.

All or part of the security may be withheld in the event of property damage and/or excessive utility charges are incurred. In such an instance the TENANT will be notified within fifteen (15) business days of vacating the property as to the amount withheld and the reason. The security deposit shall in no way be used as rental payment.

PAYMENT: In the amount of $____________ is required to cover rental for the period from __________ to . ______________.  A Fifty (50%) percent deposit is required at the time this agreement is signed and the balance within thirty (30) days prior to occupancy.  Tenant recognizes that the need to leave on their date of departure by 11:00 AM and that they cannot extend their stay without the written consent of the owner.  Further, In the event the tenant breaches the agreement and stays past the required departure date or time, then they will be held liable for any expenses caused to a tenant waiting to occupy and for any expenses the owner incurs as a result of their delayed departure.

CANCELLATIONS: Cancellations must be made in writing at least ninety (30) days prior to the scheduled arrival date. Cancellations will result in forfeiture of advance payment unless the house can be re-rented. If re-rented all money will be returned within thirty (30) days of the new booking date.

UTILITIES: All "Normal" utilities are included. Exceptions are:

* Long distance phone charges.
* Non "Basic" DSS charges such as pay movies

Note: The phone will be blocked from long distance and 900 number calls. A calling card or credit card will be required to make long distance calls.

PETS/GUESTS/SMOKING: There shall be no pets allowed on the premises unless otherwise agreed by the OWNER.  You cannot exceed the max of 10 people (max 8 adults) without our prior written approval.  In the event it is determined that you did exceed this maximum, you are waiving your right to your security refund. No smoking is allowed inside the house whatsoever.

TENANT RESPONSIBILITIES: All occupants are required to perform "Normal" household duties that include, but are not limited to:

* Garbage removal (Mondays and Thursdays)
* Cleaning of individual and guest(s) dishes
* Recycling as required by Law - (Thursdays)
* Notification of damages or problems with the property

REPAIRS: The OWNER must be notified immediately if you discover any item that needs attention. Once notified we will correct the problem with all expediency. Please be aware that for your comfort all key operational components are checked each time a Tenant vacates the property.

SURVIVAL: If any clause or term in this lease is contrary to law, the remainder of the Lease shall remain in full force.

HOLD HARMLESS AND INDEMNITY: OWNER of rental property SHALL NOT be liable for any damages and/or injury to TENANT and/or their guest(s), or their personal property due to TENANT'S acts, actions or neglect. TENANT agrees to hold OWNER harmless against any claim for damage and/or injury due to TENANT'S act or neglect.

WEATHER CONDITIONS/ACTS OF GOD: OWNER is not responsible for any weather condition or acts of God or nature that happen during TENANT'S stay on premises. Further the OWNER shall not forfeit the rental amount if the Tenant cannot get to, or stay, in the property due to any act of nature.

BOAT DOCKING: DOCK and LIFT are provided at TENANT's own risk. The LIFT need to be adjusted for the specific boat being "Lifted".  Adjustments to support this need to be completed by an experienced professional.  TENANT agrees to hold owner harmless and indemnify them for any damage or injury caused to TENANT or any of the guest(s), or any ones property due to use of the DOCK or LIFT.

LAWS: The Laws of the State of Florida shall apply to all terms under this Agreement.
